Bell-Carter Foods, LLC (the “Company” “we” or “us”) respects the privacy interests of our website visitors. This Privacy Policy describes the types of personal information that we collect, the uses we make of such information, and how you can correct or request deletion of any personal identifying information you choose to give us. Capitalized terms not otherwise defined in this document are defined in our Terms & Conditions .

Types of Information We Collect

Bell-Carter (and the vendors we hire to perform business functions on our behalf) may collect, receive, and develop several categories of personal information:

We collect Contact Information: We may collect your name, email address, mailing address, and phone number.
We collect Internet and Network Activity Information: If you use our Sites, we may collect information about the following: (i) the browser you are using or your IP address ,(ii) device identifiers, (iii)what site you came from, or what sites you visit when leaving our Sites, (iv) page interaction (such as what areas of the websites you visit and for how long, what search terms you enter, and what products or content you view and click on), and methods used to browse away from the page and (v) your subscriptions, including your subscription status (subscribed, unsubscribed, bounced) and the campaigns/coupons you have received (including date and time for each).
We collect Location Information: We collect information about your general location, using your zip code or postcode and IP address.

We collect Employment-Related Information. When you apply for a job, we collect information you submit as part of your application and resume. Such submitted information may include your work experience and previous employment, your education, the URL to your personal or professional websites, your workplace skill sets and certifications, whether you need a visa to work in the United States, and/or salary expectations.
We may collect information about your experience with our products. When you call us or leave comments on our product pages, we will collect information you provide about your experience with our products.

How We Use Your Information

We use such personal information collected from these categories for the following purposes:

We use your information to send you Club Lindsay newsletters and for other marketing purposes. We use the information you provide when you sign-up for Club Lindsay, or any other subscription services, to send you our newsletters, as well as special offers and promotions. We also use your information to advertise and market our products to you.
We use information to respond to your requests or questions. We use contact information to contact you in response to your feedback or other matters related to our relationship with you (such as about this Privacy Policy or our Terms & Conditions).
We use information to improve our products and services. For example, we may use the information you provide about our products, as well as your device, network and activity information to improve our website, services, and products.
We use information to administer our Sites and services and for internal operations. We use all categories of personal information for our internal operations, such as troubleshooting, insurance claims, data analysis, and testing.
We use information for security purposes. We may use your network and activity information or other categories of personal information as necessary to protect our company, our customers, and our business partners. We also may use this personal information to protect our websites or our services, as well as to detect and investigate activities that may be illegal or prohibited (such as cyber attacks or fraudulent activities).
We use information for hiring purposes. We use contact information and employment-related information to review your job applications and contact you about employment opportunities.
We use information to verify requests made pursuant to this Privacy Policy. We will use certain pieces of personal information to verify your identity if you make requests pursuant to this Privacy Policy. The verification steps and the pieces of personal information that we request may vary depending on the sensitivity and nature of your request.
We use information as otherwise required or permitted by law, or as we may notify you from time to time.

How We Collect Your information

We collect personal information about you from various sources, directly and indirectly. We collect these categories of personal information from the following categories of sources:

We collect personal information directly from you. We collect contact information if you sign up for the Club Lindsay newsletter, or sign up for any other marketing communications, update your subscription preferences for marketing communications, or if you contact us. We collect employment-related information if you apply for a job on our Sites. We also collect any personal information you provide if you make a request or complete a survey on our Sites. your devices.
We collect personal information from your devices through the use of Cookies and Web Beacons. To help us serve you better, we may collect information about your devices from you through technologies such as “cookies” and “web beacons” (which are also called clear GIFs, pixel tags, tracking pixels or just ‘pixels’) or by tracking internet protocol (“IP”) addresses. We collect such information when you interact with our Sites, our ads, and our emails that we or our vendors send to you. Third parties may collect such personal information on our behalf in this fashion as well. “Cookies” are small data files that are stored by your web browser when you interact with a website. When you visit a webpage, the cookie sends back device information. “Web beacons” are small graphic images (usually invisible) that can be embedded in content and ads on a webpage that track usage of the Sites and effectiveness of communication. Cookies operate in the background and you can turn them off by adjusting your Web browser settings, but doing so may make it difficult to use some of the features on the Sites or certain features of the Sites may not be available to you. We use Google Analytics. We may share your information with Google Analytics to track and analyze the use of the Sites. You can opt out of Google Analytics Advertising Features through Ads Settings and Ad Settings for mobile apps. We get personal information from vendors we hire to work on our behalf. Vendors that host or maintain our websites and send promotional emails for us may give us contact information, device information or your network or browsing information. Our employment and recruiting vendors give us contact information and employment-related information. Our marketing agencies, advertising technology vendors, and analytics providers may provide us with contact information, device information, network activity and location information.
We get information about you from other sources. Other parties may give us personal information about you. These other parties may include business and marketing partners and social media platforms that give us information they have collected either directly or indirectly from you, including contact information, network activity and location information. We may also receive employment-related information from a job network or social network if you choose to import your information from those platforms when applying for a job with us.

How We Use Your Information

For the Purpose Collected. If you provide personal information for a certain reason or purpose, we will use such personal information in connection with the reason or purpose for which it was provided. For example, we may use such information to provide technical support and respond to user inquiries, notify you about updates to our Sites or send other communications that are relevant to your use of our Sites.
Support from Service Providers: In addition, personal information, device information, browsing information and other categories of your information we collect may be used by us and by third-party service providers, such as hosting providers, data management companies, address list hosting companies, e-mail service providers, analytics companies (e.g., Google Analytics), distribution companies, fulfillment companies, and payment processors (collectively, “Service Providers”) for a variety of purposes, including to: contact you about the Sites you have requested; provide you with information you have requested, or products or services you have ordered or signed up for, such as newsletters; or facilitate the operation, maintenance and improvement of the Sites and our business operations, and internal record keeping. Our Service Providers are given the information they need to perform their designated functions in connection with the Services, and we do not authorize them to use or disclose your personal information for their own marketing or other purposes.
To provide effective advertising and marketing. We also use the information we collect and receive to provide ads for our Sites and certain third-party services, and to send you promotional communications. For example, we may use this information: to show you personalized ads (on and off our Sites, including on social networks) based on location information or your online activities, including the content you view, the products you purchase, the other Sites of ours that you use, and other information we collect and receive. We may provide a hashed version of your email address or other information to the third party for such purposes; to send you electronic and other marketing messages about Bell-Carter products, or our third-party business partners that may be tailored to your preferences. (Please see the section below entitled “All Users: Your Choices and Controls”.); and to measure and evaluate the effectiveness of online advertising campaigns;
Identity Verification and Security. We also may obtain information about you from other businesses to verify your identity so that we can properly process your requests and prevent fraud. By accessing and using our Sites, you agree that we may use your submitted and obtained personal information and device information for such purposes and to maintain the security of the Sites.
Product Improvement and Marketing. Bell-Carter may also use your personal information, device information, and other personally non-identifiable information collected through the Sites to help us improve the content and functionality of the Sites, to better understand our users, to provide customer support, and to personalize control and experiences on our Sites. Bell-Carter may use this information to communicate with you regarding the Sites, to the extent permitted by law and based on your communications preferences, to tell you about services we believe will be of interest to you.
Enforcement and Legal Obligations. Bell-Carter may use your personal information to enforce our Terms & Conditions , or investigate and prevent activities that may violate our policies or be illegal, and to respond to legal proceedings and obligations. We also may use the information we collect and receive for other purposes that may be described to you at the point of collection or for which you provide your consent.

How We Share Your Information

We share these categories of personal information under the following circumstances:

We share your personal information with our business partners, marketing companies and vendors who perform services on our behalf. We may share any and all categories of personal information with vendors, distributors and dealers who send emails on our behalf, help us manage and operate our Sites, fulfill purchases made on our Sites, provide advertising or marketing services (including social media platforms, advertising networks, and ad tech companies), provide analytics and search engine support, track advertising impressions, investigate and prevent data incidents, audit our business and financial statements, vet job applicants, provide legal advice, and place our advertisements on other platforms.
We may share your information if we believe we are required to do so in order comply with the law or to protect ourselves, our customers and others. We may share any or all categories of personal information (i) to respond to a court order or subpoena or a request for such information from a government agency or investigatory body requests (including, but not limited to, sharing your information with the U.S. government),) (ii) in order to enforce our agreements and to protect the rights of others and (iii) when we are investigating potential fraud (such fraud including, but not limited to fraud we believe occurred in relation to a promotion. If you are the winner of a sweepstakes or contest, we may also share certain of your contact information with anyone who requests a winner’s list, if required under applicable law.
We may share your personal information with a successor to all or part of our business. If part of our business is sold or there is a similar change to our corporate structure, we may include your user information as part of that transaction, which may include any or all categories of your personal information. We may also share your information with others as they conduct diligence of our organization.
We may share personal information for other reasons we may describe to you from time to time as permitted by law.

Your Choices and Controls

You can opt out of receiving our marketing emails. To stop receiving our club newsletter or other promotional emails, use the unsubscribe link at the bottom of each message or email us at policy@bellcarter.com . Even if you opt out of getting marketing messages, we will still send you transactional messages. These include responses to your questions.

You can control certain cookies and tracking tools. We use the following types of cookies:

Strictly necessary cookies. These are cookies that are required for the operation of our Sites. They include, for example, cookies that enable you to log into secure areas of our Sites. This category of cookies cannot be disabled.
Analytical cookies. These cookies allow us to recognize and count the number of visitors and to see how visitors move around our Sites when they are using them. This helps us to improve the way our Sites works, for example, by ensuring that users are finding what they are looking for easily. Information collected by Google Analytics cookies will be transmitted to and stored by Google on servers in the United States of America in accordance with its privacy practices. You may disable cookies by activating the setting on your browser that allows you to refuse the placement of all or some cookies. However, if you use your browser settings to disable all cookies (including strictly necessary cookies) you may not be able to access all or parts of the Sites.

Disabling a cookie or category of cookie does not delete the cookie from your browser. You will need to do this separately within your browser. If you have disabled one or more analytical cookies, we may still use information collected from cookies prior to your disabled preference being set.

“Do Not Track”

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services that you do not want them to track your online activities. The Sites do not currently support Do Not Track requests at this time.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

U.S. Residents: U.S. Privacy Rights

California Shine The Light[A5] [A6] Law

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us, once a year, free of charge, information about the personal information we disclosed to third parties for direct marketing purposes in the preceding calendar year. Not all information sharing is covered by the “Shine The Light” requirements and only information on covered sharing will be included in our response. Under California law, businesses are only required to respond to a request once during any calendar year.

California Consumer Privacy Act (“CCPA”)

If you are a California resident, then you also have certain rights under the California Consumer Privacy Act (“CCPA”) regarding your personal information:

Right to Know. California residents have the right to request more information regarding the following:

• The categories of personal information we have collected about you, including:

• The categories of sources from which the personal information was collected.

• Our business or commercial purposes for collecting or disclosing personal information.

• The categories of recipients to which we disclose personal information.

• The categories of personal information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of personal information.

• The specific pieces of personal information we have collected about you.

Right to Request Deletion of personal information. California residents have the right to request the deletion of personal information we have collected from you, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not attempt to reidentify the information.
Right to Correct Inaccurate personal information. If you believe that personal information we maintain about you is inaccurate, you may submit a request for us to correct that information. Upon receipt of a verifiable request to correct inaccurate personal information, we will use commercially reasonable efforts to correct the information as you direct.
Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

To exercise your Right to Know or Right to Delete under the CCPA, please submit a verifiable request to us by either calling us at 1-800-252-3557 or by sending an email to policy@bellcarter.com.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your personal information. The verifiable request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond. We may need to contact you to request additional information in order to verify you are the person about whom we collected personal information or that you are an authorized representative of such person. We will not use any information provided as part of such request (including but not limited to any contact information you provide or that we request) for any purpose other than to respond to or verify your request.

We will use reasonable efforts to respond to your verifiable request within 45 days of receipt thereof. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing either by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period before our receipt of the verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will inform you of the reason and provide you with a cost estimate before completing your request.

Your Rights In the U.S., Generally

You have rights under certain U.S. state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. Depending on the state in which you live, these rights include:

• Right to know whether or not we are processing your personal data.

• Right to access your personal data.

• Right to correct inaccuracies in your personal data.

• Right to request the deletion of your personal data.

• Right to obtain a copy of the personal data you previously shared with us.

• Right to obtain a list of specific third parties to which we have disclosed personal data (as permitted by applicable law, including Oregon’s privacy law).

• Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including California’s privacy law).

• Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including Florida’s privacy law).

Right to Know

You have the right to know and see what data we have collected about you over the past 12 months, including:

The categories of personal information we have collected about you;
The categories of sources from which the personal information is collected;
The business or commercial purpose for collecting your personal information;
The categories of third parties with whom we have shared your personal information; and
The specific pieces of personal information we have collected about you.

Right to Delete

You have the right to request that we delete the personal information we have collected from you (and direct our Service Providers to do the same). There are a number of exceptions, however, that include, but are not limited to, when the information is necessary for us or a third party to do any of the following:

Complete your transaction;
Provide you a good or service;
Perform a contract between us and you;
Protect your security and prosecute those responsible for breaching it;
Fix our system in the case of a bug;
Protect the free speech rights of you or other users;
Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
Engage in public or peer-reviewed scientific, historical, or statistical research in the public interests that adheres to all other applicable ethics and privacy laws;
Comply with a legal obligation; or
Make other internal and lawful uses of the information that are compatible with the context in which you provided it.

Exercising Your Rights

To exercise your right to know or your right to delete, please submit a verifiable consumer request to us as indicated in the “Contact Us” section of this Privacy Policy. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request to exercise your right to know twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the relevant personal information relates to you.

We will not discriminate against you for exercising any of your rights described above. Unless permitted by applicable law, we will not deny you goods or services; charge you different prices or rates for goods or services; provide you a different level or quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain U.S. state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at policy@bellcarter.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

Our site is not intended for children

We do not knowingly collect personally identifiable information from children under 18 without permission from a parent or guardian. If you are a parent or legal guardian and you think your child under 18 has given us information, you can contact us at policy@bellcarter.com.

We are a U.S. Company

We are based in the United States and process the personal information we receive in the United States. Please note that the data protection laws in the United States may be different than the laws in your region. We make no assurances or representations of any kind that the Services are suitable for use outside the U.S. or in the country in which you reside. The information we collect is kept on servers in the U.S. and may be transferred to servers in other countries, subject to the terms of this Privacy Policy. We retain the personal information that we collect for so long as we continue to have a business purpose for it.

We may link to third party sites or services we do not control

If you click on a link to a third party site, you will be taken to a website we do not control. This Policy does not apply to the privacy practices of that website, which may collect information from you. Read the privacy policy of other websites carefully. We are not responsible for these third-party websites or their policies.

Security

While we take reasonable steps to protect your personal identifying information, nothing on the internet is 100% secure. For these reasons, we cannot guarantee that all of your personal identifying information will never be disclosed in ways you do not expect or which are not described in this Privacy Policy.

Exclusions

This Privacy Policy does not apply to any personal information collected by us other than personal information collected through the Sites.

This Privacy Policy also does not apply to information about businesses or other non-individual users. We reserve the right to use and disclose aggregated or deidentified information for any commercially reasonable purpose.
